But in that residential unlawful detainer case, the court considered a defense which directly affected the amount of rent due — breach of the implied warranty of habitability. Still, there the court was faced with both fundamental and extreme defects: lack of heat, no hot water tank, broken windows, a broken door, water running through the bedroom, an improperly seated and leaking toilet, a leaking sink in the bathroom, broken water pipes in the yard, and termites in the basement. 37
