(C) Clear boarding. Pursuant to KRS 65.8838, properties found by the Code Official to be at enhanced risk of illegal entry shall be considered an imminent danger and/or a serious threat to public health, safety, and welfare requiring immediate action. Such properties shall be required to utilize clear boarding to ensure non-entry of the property. Enhanced risk of illegal entry shall include the following instances:

(1) Properties that are vacant and have been referred to the Department of Codes and Regulations for the abatement of property maintenance violations more than once within a 12-month period.

(2) Properties that are vacant and have been determined to be a Distinct Fire Hazard pursuant to 815 KAR 10:060 Section 3 (4).

(3) Vacant structures with a documented history of LMPD responses due to safety issues.

(4) Properties that are vacant and actively on the Louisville Metro Annual Cut List.
