787 charsThe act subsequently was amended to delete subsection four in its entirety. Senator Smith explained the purpose of the amendment, remarking: “Section 4 is completely deleted because of the fact that, points were well made that, no tenant . . . should be entitled to recover damages when [no one] knows how far this individual may or may not move. . . . [T]he bill, as amended, will still, in the intent, meet the [tenant’s] needs.” Id. Thus, as the recorded legislative history makes clear, the legislature expressly considered providing a private cause of action for damages based on retaliatory eviction, but then rejected that option, confident that the intent of the section, to prohibit retaliatory evictions and rent increases, would be accomplished without such a cause of action.
