2 This evidence came from one of Classic's principals, based
on his experience working with contractors. He stated that even
if a contractor told a client that closing a street for two and
one-half years was the best way to conduct a project and save
money, the client could say, "no, we can't do that. We'll have
to spend more money and make it more equitable around the
building for other people to share the burden on their
businesses." Relatedly, a Consigli project executive agreed
that Harvard either had directed or was understood to "want
[Consigli] to limit" construction impacts such as street
closures. Classic thus may be able to prove that Harvard could
control Consigli's actions in this regard.
