The landlord appeals from the denial of its motion to dismiss the tenants' appeal. The Appeals Court dismissed the tenants' appeal on timeliness ground, and we granted further appellate review. We conclude that the tenants' appeal is timely, and that the landlord's summary process complaint must be dismissed because the summons and complaint were served within fourteen days of the tenants' receipt of the notice to quit. We affirm the judgment with respect to the tenants' counterclaims.
