As here, the rent impairing violation need not be inside a tenant's apartment to raise the claim. Pursuant to MDL 302-a (3) (a) (ii), violations placed for conditions in common areas are presumed to exist inside a complaining tenant's apartment. Protestations that a tenant denied access to remediate common area violations will not serve to raise a material issue of fact regarding access.
