DISCUSSION
Respondent's singular defense pleaded in the amended answer is that he is entitled to a 100% abatement from November 30, 2023 to present pursuant to MDL 302-a. "[T]he amended answer supersedes in all respects the previous pleading (citation omitted)." (Keary v Great Atl. & Pac. Tea Co., 96 AD2d 499, 499 [1st Dept 1983]; Park v Spivey's Trucking & Rigging Co., 216 AD2d 454, 455 [2d Dept 1995] [citing to Keary and distinguishing a "second" answer under unusual circumstances from an "amended" answer which supersedes the original answer].)
