Motion to Allow Jury to Submit Questions (Motion #22) Defendant has requested that the Court permit jurors to submit questions to each witness. Plaintiff does not oppose this request. Under Vermont caselaw, it is in the discretion of the trial court to allow jurors to pose questions to the witnesses. State v. Doleszny, 2004 VT 9, ¶ 34, 176 Vt. 203. The procedure for such questioning is laid out in Doleszny as follows: (1) the jurors must submit the proposed questions to the judge and be made part of the record; (2) the judge must disclose the proposed questions to the parties and give them the opportunity to object or request the question be narrowed or rephrased; and (3) the judge must rule on each proposed question on the record, allowing, rejecting or modifying the question. The procedures should be explained to the parties and jurors at the commencement of the trial.
