We reject the contention that Mr. Codman displayed actual bias by having allegedly stated, at the beginning of the hearing, “that he thought the allegations against Mrs. Lopez and her family were sufficient to justify Phipps Houses terminating her tenancy.” The charges were obviously sufficient if proved; Codman’s statement does not differ essentially from a judge’s action in sustaining a complaint against a motion to dismiss for failure to state a claim on which relief can be granted. Our reading of Mr. Cod-man’s decision leads us to agree fully with the district judge that he made “a careful and objective analysis.” 5
