On January 11, 2017, plaintiffs moved for a preliminary in-
junction to enjoin the City from instituting eviction proceed-
ings against the Noble home residents during the pendency
of the case. They limited the bases of their motion to their the-
ories of disparate treatment and reasonable accommodation.5
    In response, the City challenged plaintiffs’ motion on only
one issue: whether plaintiffs demonstrated a reasonable like-
lihood of success on the merits. On August 3, 2017, the district
court granted plaintiffs’ motion, finding that plaintiffs pos-
sessed a reasonable likelihood of success under both theories
of liability.6 This appeal followed.7
