7 Section 3604(a) makes it unlawful “[t]o refuse to sell or rent after the making of
a bona fide offer, or to refuse to negotiate for the sale or rental of, or otherwise make
unavailable or deny, a dwelling to any person because of race, color, religion, sex, familial
status, or national origin.”
       8  Thus, as the Fifth Circuit noted in Cox v. City of Dallas, 430 F.3d 734 (5th Cir.
2005), if a landlord “refused to continue renting to a tenant because the tenant entertained
black guests,” such conduct, amounting to a constructive eviction, would constitute
discrimination in the “terms, conditions, or privileges of . . . rental,” and would be
cognizable under § 3604(b), id. at 745–47 (discussing Woods‐Drake v. Lundy, 667 F.2d 1198
(5th Cir. 1982)).
