The Broad Form Endorsement extends coverage to invasions of the right of private occupancy. One of those rights is the right to an oecupiable premises, embodied in the implied warranty of habitability. By using the Broad Form Endorsement in the insurance contract in question, Landmark obligated itself to defend its insured against allegations of the breach of the warranty of habitability. As a consequence, Landmark has and has had an obligation to defend Beltway from all claims in that suit. . Accordingly, an accompanying order will deny defendant’s motion for summary judgment and grant the motion for partial summary judgment filed by plaintiff. ORDER
