Mignone was "the master of ... her lawsuit and [could] choose which causes of action to plead." Cox v. Kansas City Chiefs Football Club, Inc. , 473 S.W.3d 107, 118 (Mo. banc 2015). As explained in § I.A., above, the discrete acts alleged in Instruction Nos. 12 and No. 13 were independently submissible as acts of purported retaliation, despite the Department's claim that Mignone presented insufficient evidence of legally cognizable damages. Even if the facts alleged by Mignone may have also supported a hostile work environment claim, the Department cites no authority which would require her to submit her claim as a hostile work environment, and we are aware of none. Point III is denied. II.
