This instruction was given at the instance of respondent: “The court instructs the jury that under the pleadings and all the evidence the defendant was not justified in ejecting the plaintiff from his office in its building, and the plaintiff is entitled to a verdict for nominal damages, at least, and, if you find from all the evidence that plaintiff, by reason of being ejected from his office, and as the direct result thereof, *624was injured in his business of lawyer — that is, lost fees, which he would have received had he not been so ejected, then in addition to nominal damages, you will assess his actual damages at such sum as you find from all the evidence will compensate him for the loss of such fees, if any.”
