Now it will be observed, that case is in all material respects identical with tbe one at bar, except as to tbe curator’s deed made by the Mississippi Yalley Trust Company in tbe attempt to convey the interest of tbe minor Gannon heirs. In that case the covenantee bad been sued in ejectment and tbe paramount outstanding title adjudged to be in another, and be even admitted that it was in her.
