488 charsInstruction No. 12 was based upon MAI 26.02, which is only applicable where there is no dispute concerning the terms of the agreement and the obligation to perform the agreement. The evidence showed that appellant had a duty to repair the roof. The evidence was uncontroverted in that both parties believed this to be true. Appellants responded to respondents’ complaints and never looked to respondents for payment for these repairs or for performance of the repairs. Point II is denied.
