Additional reasons require remand of the counterclaim for trial on the merits. The Calendar Control Judge granted partial summary judgment on the counterclaim on the ground that landlord had failed to oppose tenant’s motion seeking summary relief with respect to the rent ceiling. The action in the trial court retained its character as a landlord and tenant action even though it had been assigned to the Civil Assignment Office for trial on the civil jury calendar. Super.Ct.
