The court determined that a factual issue existed as to whether the contract was invalid due to a mistake of fact or lack of meeting of the minds of the parties in relation .to terms allowing Shelter- Plus to set the rent after a lease is signed and to prevent landlords from charging more rent than set by .Shelter Plus. Rather than proceed to trial, the parties agreed to dismiss the plaintiffs’ breach' of contract claim without prejudice, making the order granting partial summary judgment final and *100appealable. This appeal from the partial summary judgment now follows.4
