The court's instruction 12 set forth the elements of the latent defect theory, but required proof only of constructive as opposed to actual knowledge. The trial court apparently substituted constructive for actual knowledge based on RCW 59.18.060(5), which requires that a landlord know the conditions of the premises before leasing them to the tenant. 4
