Likewise, the court’s conclusions of law, which like the findings of fact were all prepared by Ms. White’s counsel, also militate against a finding of any gratuitous undertaking to repair stairs, or negligent repair of those stairs having undertaken the repair. The court simply concluded that “[b]y not having the steps in a safe condition as a minimum for habitation, the defendants breached their duty to the plaintiff to comply with the code or even some modicum of safety” (Conclusion of Law 3).
