797 charsThere is a compelling reason to recognize this defense: the protection of the health, safety, and welfare of tenants and their families. See City of Golden Valley v. Wiebesick , 899 N.W.2d 152, 166-67 (Minn. 2017) ; Zeman v. City of Minneapolis , 552 N.W.2d 548, 554 (Minn. 1996). As we noted in Wiebesick , hundreds of thousands of rental units exist in the metropolitan area alone. 899 N.W.2d at 167 n.15. We emphasized that the public "has a strong interest in preventing dangerous conditions from developing, even unknown or unintentionally, that would be hazardous to the tenants, their neighbors, and the citizens ... as a whole." Id. at 167. Evictions of tenants-some resulting in homelessness-based on their complaints about habitability are inimical to public health, safety, and welfare.
