To the extent that [the] claim for breach of the implied covenant is
       duplicative of his breach-of-contract claim, it cannot be sustained as a
       matter of law. Where a party alleges both breach of contract and
       breach of the implied covenant of good faith and fair dealing, dual
       causes of action are permitted only where the different actions are
