¶ 11. We also agree with contractor’s second point, that allowing full attorneys’-fees recovery where there is a common core of facts is consistent with the language of the statute. The statute authorizes contractor to recover attorneys’ fees if he is the substantially *356prevailing party “in any proceeding to recover any payment within the scope of this chapter.” 9 V.S.A. § 4007(c) (emphasis added). Nothing in the statute limits attorneys’-fees recovery to representation associated with a payment-withholding claim, to the exclusion of recovery for representation for other claims, such as breach of contract, arising out of the same controversy.
