           In a related argument, landlord contends that defendants were not tenants and had no
legal right to occupy apartment 2. Having concluded that there was support in the record for the
court’s finding that the parties orally agreed that tenants could live in the apartment rent-free, we
conclude that defendants were indeed tenants. They had an agreement “to occupy a residential
dwelling unit to the exclusion of others” and therefore met the definition of “tenant” in 9 V.S.A.
§ 4451(10).
