The defendants, Robin Peabody and Armand Comtois, appeal a ruling of the Keene District Court (Talbot, J.) that the plaintiffs, *83Stephen and Anne Hutchins, were entitled to recover possession of an apartment occupied by the defendants. On appeal, the defendants argue that the trial court erred when it held that RSA 540:13-d (1997) was not applicable. We reverse and remand.
