The court determined that the plaintiffs could have asserted the landlord’s violation of the Fair Housing Act as an affirmative defense in the earlier forcible entry and detainer action brought against them by the landlord in state court. Id at 917-18 & n. 5. The court indicated that a finding of a violation of the Fair Housing Act would have authorized the court in the underlying forcible entry and detainer action to enjoin the landlord’s attempt to evict the tenants. Id at 912.
