The landlord seems further to suggest that the presence of an exculpatory clause in the tenant’s lease should be evidence of the tenant’s expectations. The clause stated that the landlord would provide hot water and reasonable heat, but that failure to do so would not give rise to a damage claim. As the landlord appears to concede, this clause is void. It is an attempt to limit the landlord’s duties and liabilities under the Sanitary Code *200 and is therefore of no effect. Boston Hous.
