Where a cause of action is based on both protected activity and unprotected activity, it is subject to section 425.16 “ ‘ “unless the protected conduct is ‘merely incidental’ to the unprotected conduct.” ’ ” (Haight Ashbury, supra, 184 Cal.App.4th at p. 1551; see Peregrine Funding, Inc. v.
