Given that petitioner failed to prove a prima facie case and respondent has only asserted succession as an affirmative defense and not as a counterclaim, the court does not reach the issue of whether respondent is entitled to succession rights. Respondent may, if so advised, apply to DHCR for a determination on this issue. Based on the forgoing, the petition is dismissed.
