The rule is intended to protect a tenant from being misled by an owner’s conduct inconsistent with the parties’ agreement. In certain situations, an owner’s acceptance of rent may constitute a waiver of objection to a tenant’s breach. (See, e.g., Schwartz v Certified Mgt.
