Order, same court and Justice, entered on or about May 6, 2022, which effectively granted defendant's motion for leave to reargue and, upon reargument, adhered to its prior determinations denying defendant's motion to dismiss plaintiffs' rent overcharge claims and plaintiff Sam Waller's separate claim asserting that defendant incorrectly increased rent when renewing Waller's rent-stabilized lease after the enactment of the Housing Stability and Tenant Protection Act of 2019 (HSTPA), unanimously affirmed.
