12 Prior to its amendment in August, 2006, the Rental Housing Act of 1985 allowed a housing
provider to increase the rent ceiling in an apartment that became vacant by the greater of either
12% of the existing rent ceiling or to the rent ceiling of a "substantially identical rental unit in the
same housing accommodation." D.C. Official Code § 42-3502.13. But the housing provider
was required to take and perfect a vacancy increase by filing an amended registration form with
the Rent Administrator within 30 days of when the rental unit became vacant. 14 DCMR
