5 D.C. Official Code § 42-3502.13(d) requires disclosure to a new tenant of the lawful rent for the
housing accommodation and of any rent increases during the previous three years and the basis for
them. Therefore, even if there were no tenants in the apartment when Mr. Edwards decided to take a
vacancy increase, he still had to inform Ms. Smith and Mr. Haynes of the increase when they moved
into the apartment. As discussed above, he did not do so. -5-
