We acknowledge Ms. Fox’s argument on appeal that her second amended complaint
adequately alleged violations of the FHA’s prohibition on sexual harassment. We believe,
however, that the district court is best suited to address this question in the first instance. See
Singleton v. Wulff, 428 U.S. 106, 121 (1976) (“The matter of what questions may be taken up
and resolved for the first time on appeal is one left primarily to the discretion of the court of
appeals, to be exercised on the facts of individual cases.”). 10
