If the creditor refuses to receive the check in full satisfaction and yet takes the
          check, either it must be deemed to have assented to the satisfaction, or the debtor
          must be deemed to have assented to the creditor’s refusal, for the voluntary giving
          of the check by one, and the taking of it by the other, if neither misunderstood the
          words that were spoken, necessarily indicate assent.
