413 charsIn contrast, the lease contract in this case provides “[u]nless a party is seeking exemplary, punitive, sentimental, or personal-injury damages, the prevailing party may recover from the non-prevailing party attorney’s fees and all other litigation costs.” Thus, the contract language does not make an award of attorney fees definite, but rather conditional. This language affords the trial court some discretion.
