510 charshad completely moved. We therefore hold that the issues of constructive eviction and waiver thereof were for the jury. From what we have said it is obvious that Instruction 2 is erroneous because, without regard to delay in commencing repairs, it authorized a verdict for .plaintiff if the work of restoration, commenced before September 1st, proceeded while defendant was moving out and was completed (as to walls and roof) before defendant completed moving. Therefore the judgment for plaintiff cannot stand.
