586 charsIt is unchallenged on this appeal that a tenant claiming Housing Code violations has the right to institute a separate claim against a landlord for rent paid in excess of the reasonable rental value of leased property. This jurisdiction has already recognized that where the tenant has been required to pay rent into the court registry pending judicial settlement of his or her rental obligation, the tenant can recover any excess paid when the court enters final judgment.
