If Lincoln is bound to assume the obligations of Roni’s lease, it should be entitled to the benefits thereof. It cannot be compelled to accept the “bitter” part of the lease and be denied the “sweet.” It is only fair and equitable for Francis to turn over to Lincoln the deposit in question. 51 C. J.S.
