329 charsThe plaintiff having failed to allege an eviction by judicial proceedings and determination, is not entitled *623to maintain the action. The only effect of the giving of notice to the vendor, had there been snch proceedings, would have been to have made the judgment conclusive upon him on the issue of paramount title. Affirmed.
