¶44 Under the RLTA, landlords have an implied warranty of habitability to tenants. See RCW 59.18.060 ; Foisy v. Wyman, 83 Wash.2d 22, 28, 515 P.2d 160 (1973). This duty to keep the premises in habitable condition provides tenants with a negligence cause of action against landlords who fail to do so. See Lian v. Stalick, 106 Wash.
