The plaintiff nonetheless argues that the Trust committed an
anticipatory breach of the contract by transferring the property from the Trust
to Gary and Kevin Waterhouse personally. He argues that this action “was a
voluntary decision,” which rendered the Trust insolvent and made “[the Trust’s]
performance under the [LTA] impossible.” We disagree.
