Thereafter, the agreement was submitted to the trial court for approval;
however, the court declined to approve it. The plaintiff unsuccessfully moved
for reconsideration. In its denial of the plaintiff’s motion for reconsideration,
the court explained that the “agreement provides for issuance of a writ of
possession for an indefinite period of time in the future for the nonpayment of
future rent not yet due, in addition to the unpaid rent which forms the basis of
this eviction action,” and that RSA 540:13-c, II (2007) “does not include
authority of the court to issue a writ of possession at some indefinite time in
the future for the nonpayment of future rent not yet due.”
