There may be some doubt whether the landlord can raise the fee issue in the light of the District Court’s denial of the landlord’s request that its attorney be awarded a fee for defending the tenants’ motion to vacate. However, we are considering this issue on the assumption that the District Court’s denial was based on its belief that it lacked statutory power to award a fee rather than its interpretation of the lease.
