391 charsFor the forgoing reasons, the defendants’ appeal is sustained in part and denied in part. The papers may be remanded to the Superior Court for entry of an amended judgment to reflect that the defendants’ counterclaim was dismissed without prejudice with the approval of the court, the consent of the plaintiffs, and in accordance with Super.R.Civ.P. 41(2). GOLDBERG, J., did not participate.
