They also were awarded counsel fees in the amount of $5,000. Together with interest, judgments entered for Daniel in the amount of $24,855.68 and for Rani in the amount of $6,985.60. The Miller’s then filed a motion for a new trial. The trial justice entered a conditional order granting a new trial solely on the issue of damages unless Daniel and Rani agreed to a remittitur of $14,370 from Daniel’s award and $1,095 from Rani’s award. Both Daniel and Rani rejected the remittitur and an order was entered on July 30, 1999, granting the Millers a new trial on the issue of damages only.
