381 charsImplicit within this proviso is the requirement that the landlord have notice of the tenant’s complaint to the public authorities prior to the issuance of notice. Without proof of notice, the basis for the presumption of retaliatory action could not exist. It was undisputed that the plaintiff received notice of the tenant’s complaint from the sanitarian on or after May 16, 1979.
