Consequently, because the statute allows for a double recovery that is punitive in nature, the court must carefully review its language to ensure that a recovery for personal injuries is in fact within the scope of the statutory remedies. The court’s analysis must, therefore, proceed beyond the plain words of the statute to ensure that the proposed interpretation is consistent with the statutory scheme and the legislative intent.
