The petitioner timely filed an administrative appeal against an order issued on September I 8, 2025 by
the Rent Administrator concerning the housing accommodations knm\11 as 249 Thomas S. Boyland
Street and 2 I 6 Rockaway Avenue, Brooklyn, New York (a two-building complex) which partially
granted the owner's application for a temporary rent increase based on the installation of major
capital improvements (MCis), to wit: TV /security system; new entry doors; new common area doors.
The Administrator excluded from the approved MCI amount the costs related to various items of
work which were determined as not MCI-eligible, including the full amount of costs associated with
work performed by McLean Contracting, described by the owner in the MCI Application as '·lobby
renovations/hallway renovations." In addition, the Administrator reduced the approved costs for
certain items of work based on the Reasonable Cost Schedule which was in effect. It is noted that on
March 8, 2021, the owner tiled a second MCI Application (Docket 102100030M) for work
perfom1ed at the subject premises which included additional lobby work as well as new floor tiling in
the hallways and other common areas. 1 This Commissioner's order is being issued concurrently with
an order being issued under Docket L V2 I OOl 7RT (the tenant's appeal against the Administrator's
102100030M order), as the two appeals are interrelated.
