Comment (e) makes it clear that the rules of this section “apply only to those on the leased property with the consent of the tenant or his subtenant.” Id. at cmt. e (emphasis added).2 To allow Rice to proceed with a claim against the defendants for breach of the warranty of habitability would not accord with the Restatement (Second) of Property (Landlord and Tenant) §17.6 (1977) and thus not accord with Scott.
